Trademark Renewal in Colombia

Deadlines, official fees, documents and procedure before the SIC — a practical guide for foreign IP attorneys and brand owners.

A Colombian trademark registration is granted for ten years and must be renewed to stay in force. The renewal is filed before the Superintendencia de Industria y Comercio (SIC) and governed by Andean Community Decision 486, the industrial-property regime Colombia shares with Peru, Ecuador and Bolivia. The rules are simple, but the calendar is unforgiving: after the grace period a lapsed registration cannot be revived.

USD figures are approximate, at the rate of 2026-09-18 (USD 1 ≈ COP 3,110). Official fees are set in Colombian pesos and paid at the rate of the filing date.

The renewal window: 6 months before, 6 months after

Under article 153 of Decision 486, the owner — or anyone with a legitimate interest — may request the renewal within the six months before the expiry date. If that window is missed, the law grants a six-month grace period after expiry during which the renewal can still be filed, at a higher official fee. During the grace period the registration keeps its full effect. When the grace period ends without a renewal, the registration lapses definitively.

In practice the SIC records an online renewal within days of filing and extends the term by ten years from the original expiry date, so renewing early does not shorten the protection.

Official fees for 2026

The SIC updates its fee schedule every January. For 2026 (Resolution 6167 of 30 January 2026) the online renewal fee is COP 734,000 for the first class and COP 360,500 for each additional class of the same registration. In the grace period the same items cost COP 1,002,000 and COP 492,000. Fees are charged per registration, so a single-class registration renewed in time costs about USD 236 in official fees, and a three-class registration about USD 468.

Documents: a simple power of attorney

A foreign owner acts through a representative domiciled in Colombia. The only document needed is a simple power of attorney signed by the owner — no notarisation, apostille or consular legalisation. A scanned copy is accepted for filing. If the owner’s name has changed or the registration has been assigned since it was granted, the change should be recorded with the SIC (a recordal costs COP 486,000 in 2026) so that the renewal is issued in the correct name.

No proof of use, but use still matters

Decision 486 states expressly that no proof of use is required to renew. Use is relevant elsewhere: a registration that has not been genuinely used in an Andean Community country for three consecutive years can be cancelled for non-use at the request of a third party, and the challenger gains a preferential right to register the mark. Renewing a mark that is not in use keeps the registration but does not cure that risk.

Partial renewals and multi-class registrations

A registration can be renewed for only some of its goods or services. The official fee is then calculated on the classes actually renewed, which is often the right call for portfolios with classes that are no longer in use.

Madrid Protocol designations

Colombia joined the Madrid Protocol in 2012. An international registration designating Colombia is renewed centrally at WIPO, not through a Colombian representative, and follows the international registration’s own ten-year cycle. A local agent only becomes involved if the SIC issues a notification concerning the designation. Our renewal search lists Madrid designations separately for this reason.

What happens if the deadline is missed

After the grace period the registration is cancelled by operation of law. There is no restoration or late-renewal petition. The only route back is a new application, which is examined again, published for opposition and exposed to any conflicting application filed in the meantime. Because Colombia is a first-to-file jurisdiction, a lapsed well-known mark is a frequent target for opportunistic filings.

How to check whether a Colombian trademark is due for renewal

The SIC’s public register (SIPI) shows the expiry date of every registration.
